DoD Tracking, Killing Militants

KABUL, Afghanistan — Under the cover of a benign government information-gathering program, a Defense Department official set up a network of private contractors in Afghanistan and Pakistan to help track and kill suspected militants, according to military officials and businessmen in Afghanistan and the United States.

The official, Michael D. Furlong, hired contractors from private security companies that employed former C.I.A. and Special Forces operatives. The contractors, in turn, gathered intelligence on the whereabouts of suspected militants and the location of insurgent camps, and the information was then sent to military units and intelligence officials for possible lethal action in Afghanistan and Pakistan, the officials said.

While it has been widely reported that the C.I.A. and the military are attacking operatives of Al Qaeda and others through unmanned, remote-controlled drone strikes, some American officials say they became troubled that Mr. Furlong seemed to be running an off-the-books spy operation. The officials say they are not sure who condoned and supervised his work.

It is generally considered illegal for the military to hire contractors to act as covert spies. Officials said Mr. Furlong’s secret network might have been improperly financed by diverting money from a program designed to merely gather information about the region.

Moreover, in Pakistan, where Al Qaeda and Taliban leaders are believed to be hiding, the secret use of private contractors may be seen as an attempt to get around the Pakistani government’s prohibition of American military personnel’s operating in the country.

Officials say Mr. Furlong’s operation seems to have been shut down, and he is now is the subject of a criminal investigation by the Defense Department for a number of possible offenses, including contract fraud.

Even in a region of the world known for intrigue, Mr. Furlong’s story stands out. At times, his operation featured a mysterious American company run by retired Special Operations officers and an iconic C.I.A. figure who had a role in some of the agency’s most famous episodes, including the Iran-Contra affair.

The allegations that he ran this network come as the American intelligence community confronts other instances in which private contractors may have been improperly used on delicate and questionable operations, including secret raids in Iraq and an assassinations program that was halted before it got off the ground.

“While no legitimate intelligence operations got screwed up, it’s generally a bad idea to have freelancers running around a war zone pretending to be James Bond,” one American government official said. But it is still murky whether Mr. Furlong had approval from top commanders or whether he might have been running a rogue operation.

This account of his activities is based on interviews with American military and intelligence officials and businessmen in the region. They insisted on anonymity in discussing a delicate case that is under investigation.

Col. Kathleen Cook, a spokeswoman for United States Strategic Command, which oversees Mr. Furlong’s work, declined to make him available for an interview. Military officials said Mr. Furlong, a retired Air Force officer, is now a senior civilian employee in the military, a full-time Defense Department employee based at Lackland Air Force Base in San Antonio.

Network of Informants

Mr. Furlong has extensive experience in “psychological operations” — the military term for the use of information in warfare — and he plied his trade in a number of places, including Iraq and the Balkans. It is unclear exactly when Mr. Furlong’s operations began. But officials said they seemed to accelerate in the summer of 2009, and by the time they ended, he and his colleagues had established a network of informants in Afghanistan and Pakistan whose job it was to help locate people believed to be insurgents.

Government officials said they believed that Mr. Furlong might have channeled money away from a program intended to provide American commanders with information about Afghanistan’s social and tribal landscape, and toward secret efforts to hunt militants on both sides of the country’s porous border with Pakistan.

Some officials said it was unclear whether these operations actually resulted in the deaths of militants, though others involved in the operation said that they did.

Military officials said that Mr. Furlong would often boast about his network of informants in Afghanistan and Pakistan to senior military officers, and in one instance said a group of suspected militants carrying rockets by mule over the border had been singled out and killed as a result of his efforts.

In addition, at least one government contractor who worked with Mr. Furlong in Afghanistan last year maintains that he saw evidence that the information was used for attacking militants.

The contractor, Robert Young Pelton, an author who writes extensively about war zones, said that the government hired him to gather information about Afghanistan and that Mr. Furlong improperly used his work. “We were providing information so they could better understand the situation in Afghanistan, and it was being used to kill people,” Mr. Pelton said.

He said that he and Eason Jordan, a former television news executive, had been hired by the military to run a public Web site to help the government gain a better understanding of a region that bedeviled them. Recently, the top military intelligence official in Afghanistan publicly said that intelligence collection was skewed too heavily toward hunting terrorists, at the expense of gaining a deeper understanding of the country.

Instead, Mr. Pelton said, millions of dollars that were supposed to go to the Web site were redirected by Mr. Furlong toward intelligence gathering for the purpose of attacking militants.

In one example, Mr. Pelton said he had been told by Afghan colleagues that video images that he posted on the Web site had been used for an American strike in the South Waziristan region of Pakistan.

Among the contractors Mr. Furlong appears to have used to conduct intelligence gathering was International Media Ventures, a private “strategic communication” firm run by several former Special Operations officers. Another was American International Security Corporation, a Boston-based company run by Mike Taylor, a former Green Beret. In a phone interview, Mr. Taylor said that at one point he had employed Duane Clarridge, known as Dewey, a former top C.I.A. official who has been linked to a generation of C.I.A. adventures, including the Iran-Contra scandal.

In an interview, Mr. Clarridge denied that he had worked with Mr. Furlong in any operation in Afghanistan or Pakistan. “I don’t know anything about that,” he said.

Mr. Taylor, who is chief executive of A.I.S.C., said his company gathered information on both sides of the border to give military officials information about possible threats to American forces. He said his company was not specifically hired to provide information to kill insurgents.

Some American officials contend that Mr. Furlong’s efforts amounted to little. Nevertheless, they provoked the ire of the C.I.A.

Last fall, the spy agency’s station chief in Kabul, Afghanistan’s capital, wrote a memorandum to the Defense Department’s top intelligence official detailing what officials said were serious offenses by Mr. Furlong. The officials would not specify the offenses, but the officer’s cable helped set off the Pentagon investigation.

Afghan Intelligence

In mid-2008, the military put Mr. Furlong in charge of a program to use private companies to gather information about the political and tribal culture of Afghanistan. Some of the approximately $22 million in government money allotted to this effort went to International Media Ventures, with offices in St. Petersburg, Fla., San Antonio and elsewhere. On its Web site, the company describes itself as a public relations company, “an industry leader in creating potent messaging content and interactive communications.”

The Web site also shows that several of its senior executives are former members of the military’s Special Operations forces, including former commandos from Delta Force, which has been used extensively since the Sept. 11 attacks to track and kill suspected terrorists.

Until recently, one of the members of International Media’s board of directors was Gen. Dell L. Dailey, former head of Joint Special Operations Command, which oversees the military’s covert units.

In an e-mail message, General Dailey said that he had resigned his post on the company’s board, but he did not say when. He did not give details about the company’s work with the American military, and other company executives declined to comment.

In an interview, Rear Adm. Gregory Smith, the top military spokesman in Afghanistan, said that the United States military was currently employing nine International Media Ventures civilian employees on routine jobs in guard work and information processing and analysis. Whatever else other International Media employees might be doing in Afghanistan, he said, he did not know and had no responsibility for their actions.

By Mr. Pelton’s account, Mr. Furlong, in conversations with him and his colleagues, referred to his stable of contractors as “my Jason Bournes,” a reference to the fictional American assassin created by the novelist Robert Ludlum and played in movies by the actor Matt Damon.

Military officials said that Mr. Furlong would occasionally brag to his superiors about having Mr. Clarridge’s services at his disposal. Last summer, Mr. Furlong told colleagues that he was working with Mr. Clarridge to secure the release of Pfc. Bowe Bergdahl, a kidnapped soldier who American officials believe is being held by militants in Pakistan.

From December 2008 to mid-June 2009, both Mr. Taylor and Mr. Clarridge were hired to assist The New York Times in the case of David Rohde, the Times reporter who was kidnapped by militants in Afghanistan and held for seven months in Pakistan’s tribal areas. The reporter ultimately escaped on his own.

The idea for the government information program was thought up sometime in 2008 by Mr. Jordan, a former CNN news chief, and his partner Mr. Pelton, whose books include “The World’s Most Dangerous Places” and “Licensed to Kill: Hired Guns in the War on Terror.”

Top General Approached

They approached Gen. David D. McKiernan, soon to become the top American commander in Afghanistan. Their proposal was to set up a reporting and research network in Afghanistan and Pakistan for the American military and private clients who were trying to understand a complex region that had become vital to Western interests. They already had a similar operation in Iraq — called “Iraq Slogger,” which employed local Iraqis to report and write news stories for their Web site. Mr. Jordan proposed setting up a similar Web site in Afghanistan and Pakistan — except that the operation would be largely financed by the American military. The name of the Web site was Afpax.

Mr. Jordan said that he had gone to the United States military because the business in Iraq was not profitable relying solely on private clients. He described his proposal as essentially a news gathering operation, involving only unclassified materials gathered openly by his employees. “It was all open-source,” he said.

When Mr. Jordan made the pitch to General McKiernan, Mr. Furlong was also present, according to Mr. Jordan. General McKiernan endorsed the proposal, and Mr. Furlong said that he could find financing for Afpax, both Mr. Jordan and Mr. Pelton said. “On that day, they told us to get to work,” Mr. Pelton said.

But Mr. Jordan said that the help from Mr. Furlong ended up being extremely limited. He said he was paid twice — once to help the company with start-up costs and another time for a report his group had written. Mr. Jordan declined to talk about exact figures, but said the amount of money was a “small fraction” of what he had proposed — and what it took to run his news gathering operation.

Whenever he asked for financing, Mr. Jordan said, Mr. Furlong told him that the money was being used for other things, and that the appetite for Mr. Jordan’s services was diminishing.

“He told us that there was less and less money for what we were doing, and less of an appreciation for what we were doing,” he said.

Admiral Smith, the military’s director for strategic communications, said that when he arrived in Kabul a year later, in June 2009, he opposed financing Afpax. He said that he did not need what Mr. Pelton and Mr. Jordan were offering and that the service seemed uncomfortably close to crossing into intelligence gathering — which could have meant making targets of individuals.

“I took the air out of the balloon,” he said.

Admiral Smith said that the C.I.A. was against the proposal for the same reasons. Mr. Furlong persisted in pushing the project, he said.

“I finally had to tell him, ‘Read my lips,’ we’re not interested,’ ” Admiral Smith said.

What happened next is unclear.

Admiral Smith said that when he turned down the Afpax proposal, Mr. Furlong wanted to spend the leftover money elsewhere. That is when Mr. Furlong agreed to provide some of International Media Ventures’ employees to the strategic communications command, which Admiral Smith oversees.

But that still left roughly $15 million unaccounted for, he said.

“I have no idea where the rest of the money is going,” Admiral Smith said.

Israeli Covert Assassination Campaign

Israel is waging a covert assassination campaign across the Middle East in an effort to stop its key enemies co-ordinating their activities.

Israeli agents have been targeting meetings between members of Hamas and the leadership of the militant Hezbollah group, and the Iranian Revolutionary Guards.

They are also suspected of recent killings in Dubai, Damascus and Beirut. While Israel’s Mossad spy agency has been suspected of staging assassinations across the world since the 1970s, it does not officially acknowledge or admit its activities.

The current spate of killings began in December when a “tourist bus” carrying Iranian officials and Hamas members exploded outside Damascus. The official report by Syria claimed that a tyre had exploded but photographs surfaced showing the charred remains of the vehicle — prompting speculation that a much larger explosion had taken place.

Several weeks later a meeting between members of Hamas, which controls Gaza, and their counterparts from Hezbollah in its southern Beirut stronghold in Lebanon was also attacked, resulting in several deaths.

Hamas had sought to cover up the incidents because it was embarrassed, a senior Palestinian official in Ramallah told The Times.

“There has been growing co-operation between Gaza and Iran. Israel can read the writing on the wall and they know that with the help of Iran, the Hamas Government in Gaza will become stronger and will fight better.

“But Israel is overstepping their boundaries. Other countries don’t want to become a killing field for the Israeli-Palestinian conflict.”

Most recently, the top Hamas leader Mahmoud al-Mabhouh was killed in Dubai on January 19, 2010. He is believed to have been poisoned by a woman who visited his room at the Al Bustan Rotana Hotel in Dubai.

Israeli officials said that Mabhouh had been a key figure in procuring Iranian-made longer-range rockets for Hamas that could be fired at targets in central Israel.

The exiled Hamas leader Khaled Mashaal has vowed revenge for Mabhouh’s death. He has also suggested that the current fighting between Hamas and Israel will become more regional. In an interview with the London-based al-Hayat newspaper, Mr Mashaal said that future wars with Israel would not be fought solely in the Gaza Strip.

Under the current Mossad chief, Meir Dagan, Israel is believed to have renewed efforts to kill high-level opponents. Only months after the former paratrooper assumed leadership of the intelligence service in October 2002, senior Hezbollah operatives in Lebanon began to be targeted. He was credited with ordering the killing of two relatively senior Hezbollah members who were killed in southern Beirut in July 2003 and August 2004.

More recently, Israel has been accused of planting a car bomb in Damascus that killed the top Hezbollah leader Imad Mughniyah in February 2008. The Israeli Cabinet minister Daniel Herschkowitz last week praised the Mossad chief as one of the agency’s most successful leaders.

When asked about Mossad’s involvement in the Dubai slaying, Eli Yishai, the Interior Minister, smiled and said: “All the security services make, thank God, great efforts to safeguard the security of the state of Israel.”

While some countries are questioning whether Israel isn’t taking credit to increase the reputation of its defence establishment, other moderate Arab States are now describing the assassinations as a “covert war” between Israel and Hamas.

Diplomats said they were aware that covert Israeli operations had increased. “We watch their comings and goings; we are aware that there is more activity both on our ground and other countries in the region,” said an Egyptian diplomat. “They are trying to embroil us all in their conflict.”

Tensions between Israel and Hamas have remained high, despite the relative quiet that has ensued since the end of Israel’s offensive in Gaza last winter. Israeli troops were placed on alert yesterday after intelligence suggested that Hamas planned to abduct soldiers. Israel said this week that it had foiled a kidnapping in December by arresting the Hamas operative Slaman Abu Atik on the Israeli-Gaza border. He planned to enter Israel via Egypt, said the Shin Bet, Israel’s internal security service.

No Trial Assassination of Americans Abroad

Allegedly the U.S. has created an illegal “hit list” of  Fellow Americans abroad marked for murder.

Director of National Intelligence Dennis Blair told a House Intelligence Committee hearing February 3rd the U.S. may, with executive approval, target and kill American terrorist suspects, Inter Press News Service of Rome reported. ”We take direct action against terrorists in the intelligence community,” he said.

Blair’s statement recalls the policies of Soviet Russia’s secret police, who often murdered those who fled Stalin’s tyranny. Red Army founder Leon Trotsky, for example, was tracked to Mexico by a Soviet agent who killed him with an ice pick.

Ben Wizner, staff attorney with the ACLU National Security Project, said, ”It is alarming to hear that the Obama administration is asserting that the president can authorize the assassination of Americans abroad, even if they are far from any battlefield and may have never taken up arms against the U.S., but have only been deemed to constitute an unspecified ‘threat.’”

Blair’s remarks followed a Washington Post article reporting President Barack Obama had embraced President George W. Bush’s policy of authorizing the killing of U.S. citizens involved in terrorist activities overseas.

The Post reported: “After the Sep. 11, 2001, attacks, Bush gave the CIA, and later the military, authority to kill U.S. citizens abroad if strong evidence existed that an American was involved in organizing or carrying out terrorist actions against the United States or U.S. interests, military and intelligence officials said. The evidence has to meet a certain, defined threshold. The person, for example, has to pose ‘a continuing and imminent threat’ to U.S. persons and interests.”

Attorney George Brent Mickum, an American lawyer who has defended a number of Guantanamo Bay detainees, told Inter Press, ”I guess my sense is that it’s just more fear mongering. They kill somebody and don’t need to offer any justification.”

”We have killed thousands of innocent civilians while attempting to target alleged operatives,” Mickum said. “And let us not forget how frequently our intelligence has been wrong about alleged operatives,” he added.

“My clients Bisher al Rawi, Jamil el-Banna, Martin Mubanga, abu Zubaydah, and Shaker Aamer all are alleged to have been operatives based on intel. In every case that intel was incorrect,” Mickum told Inter Press. “I don’t have any expectation that our intel with respect to alleged American operatives is likely to be any better.”

“This extrajudicial execution of human beings constitutes a grave violation of international human rights law and, under certain circumstances, can also constitute a war crime under the Four Geneva Conventions of 1949,” said Francis Boyle, University of Illinois professor of international law at Champaign.

“In addition, the extrajudicial execution of U.S. citizens by the United States government also violates the Fifth Amendment to the United States Constitution mandating that no person “be deprived of life, liberty, or property, without due process of law.”

Boyle said, “The U.S. Government has now established a ‘death list’ for U.S. citizens abroad  akin to those established by Latin American dictatorships  during their so-called ‘dirty wars.’”

He claimed President Bush “reduced the United States of America to a Banana Republic waging a ‘dirty war’ around the world in gross violation of international law, human rights law, and the laws of war.  It is only a matter of time before the United States government will establish a similar ‘death list’ targeting U.S. citizens living here at home.” He added that, “As someone who used to teach Constitutional law, President Obama knows better.”

Boyle, a leading U.S. authority in international law, drafted the Biological Weapons Anti-Terrorism Act of 1989 for the U.S. He is the author of a number of books in his field, including “Destroying World Order”(Clarity).

Daphne Eviatar, an attorney with Human Rights First, told Inter Press, ”The short answer is that combatants can be targeted and civilians cannot under international law. Their citizenship isn’t relevant. But just being a ’suspected terrorist’ doesn’t necessarily mean they’re a combatant.”

She added, ”The key question, and where there may be serious disagreement, is whether the person targeted is ‘directly participating in hostilities’. If not, and they’re targeted, it’s a war crime.”

Chip Pitts, president of the Bill of Rights Defence Committee, told Inter Press, ”As with its embrace of the [George W.] Bush approach to indefinite detention, the Obama administration’s even greater reliance on targeted extra-judicial killing – including of U.S. citizens – is a tragic legal, moral, and practical mistake.”

”Even for those who accept the legitimacy of the death penalty,” Pitts continued, “this further undermines the rule of law that is our best weapon in the fight against true terrorists, while completely subverting due process and constitutional rights of U.S. citizens.”

In his testimony before the House of Representatives Intelligence Committee, Blair said, ”We take direct action against terrorists in the intelligence community,” Inter Press reported. He said U.S. counterterrorism officials may try to kill U.S. citizens involved in extremist groups overseas with ”specific permission” from higher up.

In response to questions from the panel’s top Republican, Rep. Pete Hoekstra of Michigan, Blair said, if ”we think that direct action will involve killing an American, we get specific permission to do that.”

CIA Employed Blackwater for Assassinations

Hats off to Mark Mazzetti of the New York Times for rooting out what it was that sent CIA Director Leon Panetta scurrying over to Congress in late June.

According to Mazzetti, Panetta’s top lieutenants, many of them holdovers from the last administration, had just told him that, under President Bush, they had farmed out assassinations to their Blackwater subsidiary.  I use “they” advisedly, since the CIA holdovers that had kept Panetta in the dark continue to function as Panetta’s top managers.

Panetta abruptly stopped the project and contritely briefed the intelligence committees.  Until now, it was not clear what had prompted Panetta to set up hurried consultations with the intelligence “oversight” committees of the House and Senate.

An odd odor still hangs over the affair. After being briefed by Panetta, one committee member described him as “stunned” that his lingering lieutenants had kept information on the program from him until nearly five months into his tenure. Yet there is not the faintest hint that anyone on either committee dared to ask why Panetta continues to leave such tainted officials in very senior positions.

Anyone know why he does not send them packing?

Mazzetti quotes officials as admitting that “the C.I.A. did not have a formal contract with Blackwater” for a program with “lethal” authority. Putting out contracts on other people, I suppose you might call it, without a contract. http://www.nytimes.com/2009/08/20/us/20intel.html?_r=2

What Mazzetti does not mention — and what he, like the vast majority of Americans, may not know — is that there is a one-sentence umbrella “contract” available for use as authorization for such activities. It creates a structural fault, so to speak, and a legal loophole through which Bush and Cheney drove a Mack truck of lawlessness.

Useful Ambiguity

Bush administration lawyers were not the first to read considerable leeway into that loophole created by just one sentence in the language of the National Security Act of 1947. The sentence can be (ab)used as authorization for all manner of crime — irrespective of existing law or executive order.

A Cheney-esque “unitary executive” perspective and a dismissive attitude toward lawmakers reinforced the Bush team’s predilection to exploit the ambiguous language, taking it further than it had ever been taken in the past.

The Act (as slightly amended) stipulates that the CIA Director shall:

“Perform such functions and duties related to intelligence affecting the national security as the President or the National Security Council may from time to time direct.”

There’s the “umbrella contract.” While more than one past President (I served under seven during my tenure at CIA) has taken advantage of that open language, the Bush administration translated the dodging into a new art form. Cheney Aide Confirms Assassination Ring

Last month, The New Yorker’s Seymour Hersh revealed in Minnesota that former vice president Cheney presided over an “executive assassination ring.” “Under President Bush’s authority, they’ve been going into countries, not talking to the ambassador or the CIA station chief, and finding people on a list and executing them and leaving,” Hersh explained.

Today, CNN interviewed Hersh and former Cheney national security aide John Hannah. Although he expressed regret for revealing the story (calling it a “dumb-dumb”), Hersh stood by his initial statements. “I’m sorry, Wolf, I have a lot of problems with it,” he said about the assassination scheme:

HERSH: I know for sure…the idea that we have a unit that goes around, without reporting to Congress… and has authority from the President to go into the country without telling the CIA station chief or the ambassador and whack somebody. … You’ve delegated authority to troops in the field to hit people on the basis of whatever intelligence they think is good.

Hannah replied that Hersh’s account of the assassination scheme “is not true.” Yet in the same breath, when asked about a “list” of assassination targets, Hannah echoed Hersh’s statements. Hannah said that “troops in the field” are given “authority” to “capture or kill certain individuals” who are perceived as a threat. “That’s certainly true,” he said:

Q: Is there a list of suspected terrorists out there who can be assassinated?

HANNAH: There’s clearly a group of people that go through a very extremely well-vetted process, interagency process…that have committed acts of war against the United States, who are at war with the United States or are suspected of planning operations of war against the United States, who authority is given to our troops in the field in certain war theaters to capture or kill those individuals. That is certainly true.

Hannah didn’t directly dispute Hersh’s claim that Congress wasn’t informed about the assassinations. “It is extremely hard for me to believe,” he said. Watch it Here:

Speaking about the program to MSNBC’s Keith Olbermann, former Nixon White House counsel John Dean said, “It’s potentially a war crime, it‘s potentially just outright murder, and it could clearly be in violation of the Ford executive order” — referring to a 1976 Executive Order that said, “No employee of the United States government shall engage in or conspire to engage in political assassination.”
